Most criminal cases do not go to trial, but are settled out of court. There are many reasons why clients decide to settle. Considerations that go into these decisions include the following:

- The surrounding circumstances of each situation
- The surrounding circumstances of the person or people involved
- The wishes of the client
Settlement can involve all aspects of a case, from a pre-trial dismissal of all charges to negotiating the charges or consequences themselves (so that lesser or other more minor charges or consequences may be applied). For drug cases, alternatives to criminal consequences may exist, such as drug diversion programs, court ordered treatment programs, or private treatment programs. Because settlement requires both sides to agree, it is not always possible.
